الإفتاء ومسؤولية المسلم في إدراك أحكام الله

آراء فقهية
أولا يجب أن نوضح شيئا مهما، هو ان كل مسلم يتحمل وزره ولا أحد يتحمل وزر آخر، لقوله تعالى : ولا تزر وازرة وزر أخرى.
معنى هذا الكلام أننا يجب أن نتحرى باستمرار حقيقة ما نتلقى من فهم ديني بخصوص الأحكام والتوصيات والرخص وغيرها، ولا يظن أحد أنه سوف يلقي باللوم على من أفتى له بمسألة أو أجاز له بشيء، لكي يتهرب من المحاسبة، فكلنا سوف نأتي ربنا فرادى كما خلقنا أول مرة، وليس فلان أو علان من سيحمل وزرنا يوم القيامة.
كمثال : قضية الصوم أو الإفطار بالنسبة للمرضى، هي قضية لا تحتاج إلى إفتاء أو وصاية من أحد، فحتى الفقهاء مهمتهم إرشادية فقط ومطلوب منهم أن يبينوا لك قول الشرع في ذلك، ولك وحدك القرار في تنفيذه، بناء على ما هضمه عقلك، وما ارتاحت إليه سريرتك.
ثم كذلك فالله سبحانه وتعالى لم ينزل القرآن الحكيم بآياته التي تبلغ 6236 آية لكي نحتاج إلى آلاف الكتب والفتاوى والأبحاث كي نفهم حكما بسيطا كالذي بين أيدينا، وكما هي جل الأحكام.
فقوله تعالى :
فَمَن كَانَ مِنكُم مَّرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِّنْ أَيَّامٍ أُخَرَ وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ فَمَن تَطَوَّعَ خَيْرًا فَهُوَ خَيْرٌ لَّهُ وَأَن تَصُومُواْ خَيْرٌ لَّكُمْ إِن كُنتُمْ تَعْلَمُونَ
لا يحتاج إلى تخصص فقهي كبير لكي نفهم أن الصيام مكتوب على غير المريض وغير المسافر، وأنه من الممكن ان تتطوع وتصوم إذا كان مرضك لا علاقة له بالأكل والشرب، لأن في الصوم خير لنا.كذلك السفر، إذا كان سفرك متعب لدرجة أنك لا تستطيع الامتناع عن الأكل أو الشرب، فلا حرج عليك، والمسألة لا علاقة لها بمسافة 80 كلم التي يتكلم عنها الفقه، فالسفر قديما فوق البغال والجمال ليس هو السفر في السيارة أو الطائرة، فلا يصح القياس على ذلك، المسألة مسألة استطاعة، فشخصيا لم أفطر قط في سفرياتي الرمضانية ولم أشعر يوما بحاجتي إلى الإفطار.
بالنسبة للمريض، لسنا مجبرين أن نسطر قائمة الأمراض التي تمكن من الإفطار، أولا هي مسألة استطاعة، ولا أحد يمكن أن يحكم على الاستطاعة إلا ربنا سبحانه وتعالى لأنها أمر بينك وبينه، فإذا كنت مستطيعا رغم مرضك فصيامك تطوعا هو خير لك، وإذا كان في صيامك خطر على صحتك فلا يجوز لك الصيام، لأن الصيام في حد ذاته مفروض على غير المريض.
تبقى مسألة المرضى بأمراض مزمنة، والذين يحتاجون أدوية يجب تناولها نهارا، فالأمر محسوم: لا صيام، أما إذا كان ممكنا تناول الأدوية ليلا أي من المغرب إلى الفجر، فمن الممكن أن يصوموا خصوصا إذا كان مرضهم لا يتعلق بأكل أو شرب، والطبيب هنا هو من يحسم هذه المسألة ولا أحد غيره، وحتى إذا أجاز له الطبيب بذلك فبشرط عدم وقوع أعراض تشكل خطرا على المريض.
باختصار المريض هو طبيب نفسه، وإذا لم يرد أن يدخل في هذه المتاهات، فلا حرج عليه، فليفطر، وليقض أياما أخرى عندما يصح، أو يكفر بإطعام مسكين عن كل يوم إدا لم يصح واستمر مرضه لمدة طويلة.
ما أريد قوله، هو أن ديننا بسيط وليس بذلك التعقيد.
من الواجب على المسلم أن يفهم حكم الله وإذا لم يستطع الفهم فليسأل، ولكن لا يجمد عقله ويتكأ على فتاوي الغير بحجة عدم الاختصاص فهذا هو ما يجب تجنبه، هذا ما حاولت ان أبين خطره سابقا.
لا أريد أن أطيل، أردت أن أبين مسألة في غاية الأهمية، هو أننا مصابون بالكسل الفكري، ليس فقط في أمور الدين بل في أمور عدة، العلم والتعلم ما يحل الإشكال، يجب أن نبحث ونستقصي ونتحاور ونتجادل بالتي هي أحسن، وألا نكون نرجسيين في التفكير، فكما قلت من قبل لا أحد يمتلك الحقيقة المطلقة، وحده كلام الله هو المطلق وله الحاكمية، إليه نحتكم وبه نستهدي.
